Terms of Service

These Terms of Service ("Terms") govern your access to and use of InstaCompare, including our website, dashboard, reports, and related services (collectively, the "Service"), operated by Proluma Innovations Private Limited ("InstaCompare," "we," "us," or "our").

By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to use the Service. By using the Service, you represent that you meet this requirement and that you have the authority to enter into these Terms on behalf of yourself or the organization you represent.

InstaCompare provides analytics and comparison tools for publicly available Instagram account data, including but not limited to follower counts, engagement metrics, post frequency, and AI-generated summaries of publicly posted content. The Service is intended for competitive research, marketing analysis, and reporting purposes.

InstaCompare is not affiliated with, endorsed by, or sponsored by Instagram or Meta Platforms, Inc. "Instagram" is a trademark of Meta Platforms, Inc.

4.1 InstaCompare retrieves account data through Meta's official Graph API and Instagram Platform APIs, in accordance with Meta's Platform Terms. You acknowledge that the accuracy, availability, and completeness of this data depends on third-party platforms and may change without notice.

4.2 We do not access, store, or process private/non-public Instagram accounts or content, and we do not request or store Instagram login credentials for any account you are analyzing (only, where applicable, for your own connected account).

4.3 Data displayed through the Service reflects a snapshot in time and may not exactly match real-time figures on Instagram.

5.1 You must provide accurate and complete information when creating an account and keep your login credentials confidential.

5.2 You are responsible for all activity that occurs under your account.

5.3 We may suspend or terminate accounts that violate these Terms, applicable law, or that we reasonably believe are being used for abusive, fraudulent, or harmful purposes.

6.1 InstaCompare offers Free, Starter, Pro, and Agency plans as described on our Pricing page. Features and usage limits for each plan are subject to change with reasonable notice.

6.2 Paid subscriptions are billed in advance on a recurring basis (monthly or annually, as selected) and automatically renew unless cancelled prior to the renewal date.

6.3 You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period. Except where required by law, fees already paid are non-refundable.

6.4 We reserve the right to change pricing with at least 30 days' notice to existing subscribers.

You agree not to:

• Use the Service to harass, stalk, defame, or violate the privacy of any individual or Instagram account holder;

• Use the Service to scrape, extract, or republish data at a scale or in a manner that violates Instagram's or Meta's own terms of service beyond InstaCompare's intended functionality;

• Attempt to reverse-engineer, decompile, or interfere with the Service's underlying systems;

• Use automated means (bots, scrapers) to access the Service outside of provided features;

• Resell, sublicense, or white-label the Service itself (as distinct from exported reports, which are permitted under your plan) without our written consent;

• Use the Service in violation of any applicable law, including data protection and intellectual property law.

8.1 The Service, including its software, design, branding, and AI-generated analysis features, is owned by InstaCompare and protected by intellectual property laws. These Terms do not grant you any ownership rights in the Service.

8.2 Reports, charts, and exports you generate using your subscription are yours to use for your own business or client purposes, including white-label use where offered under your plan.

8.3 Instagram account data, usernames, and content referenced through the Service remain the property of their respective account holders and Instagram/Meta.

You acknowledge that Instagram/Meta's own terms of service may restrict certain uses of data obtained from their platform, and that compliance with those third-party terms is a shared responsibility. InstaCompare will make reasonable efforts to operate within applicable platform policies, but you remain responsible for how you use exported data (e.g., in client reports).

10.1 The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

10.2 We do not guarantee the accuracy, completeness, or timeliness of any analytics, estimates (including follower growth or reach estimates), or AI-generated summaries. These are provided for informational purposes only and should not be the sole basis for business decisions.

10.3 We do not guarantee uninterrupted or error-free access to the Service, including due to changes made by Instagram/Meta to their platform.

To the maximum extent permitted by law, InstaCompare and its officers, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the Service. Our total liability for any claim arising from these Terms or the Service will not exceed the amount you paid us in the 12 months preceding the claim.

You agree to indemnify and hold InstaCompare harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your misuse of the Service, violation of these Terms, or violation of any third party's rights, including rights of Instagram account holders or Meta's platform terms.

We may suspend or terminate your access to the Service at any time for violation of these Terms. You may stop using the Service and cancel your account at any time. Sections that by their nature should survive termination (e.g., Intellectual Property, Disclaimers, Limitation of Liability) will survive.

We may update these Terms from time to time. We will provide notice of material changes (e.g., via email or in-app notice) at least 14 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance.

These Terms are governed by the laws of Udaipur, Rajasthan, India, without regard to conflict-of-law principles. Any disputes will be resolved in the courts located in Udaipur, Rajasthan, India, unless otherwise required by applicable consumer protection law.
